A settlement has been reached with Olinsky & Associates, PLLC (“Olinsky” or “Defendant”) in a class action lawsuit (“Settlement”). This case concerns Plaintiffs’ allegations regarding the cyberattack on Olinsky's computer systems that occurred in January 2025 (the “Data Incident”). Olinsky determined personally identifiable information and protected health information were potentially impacted during the Data Incident. The potentially impacted information was different for each individual and included: names, addresses, Social Security numbers, account information, financial information, medical records or disability-payment information, driver’s license numbers, financial information, and health insurance information. Some of the information was truncated, only exposing the last four or five digits of the social security number or bank account information.
The lawsuit is called Leon-Roman v. Olinsky & Associates, PLLC, Case No. 5:25-cv-000462-ECC-CBF (the “Litigation”), which is pending in the United States District Court for the Northern District of New York. In the Litigation, the Plaintiff brings claims for negligence, breach of implied contract, and unjust enrichment and seeks damages and injunctive relief concerning the Data Incident. Olinsky denies that it did anything wrong and would assert defenses to the claims if the Litigation were not settling. The Court has not decided who is right. The parties have agreed to settle the Litigation to avoid the expected massive costs of litigating through trial, the inherent risk that either party will lose before or at trial, and the potential damage to Olinsky associated with prolonged litigation; and to achieve a final resolution for the Settlement Class and Olinsky as to all issues raised in the Litigation.
If you received notice, Olinsky's records indicate that you are a Class Member and are entitled to benefits under the Settlement. You may have received a previous notice directly from Olinsky.
Under the Settlement Agreement, Class Members will automatically receive a Credit Monitoring activation code for 3 years of CyEx’s Financial Shield Complete, and a Settlement check of $40.00 mailed to their last known mailing address. A Class Member may update their check mailing address or elect to receive this payment digitally, by Zelle, PayPal, Venmo, Mastercard or ACH, by completing the Payment Election form here.
If you were identified as a member of the Settlement Class, your rights are affected whether you act or don’t act. Please read the Notice carefully and completely.
